Terms of Use

These Terms of Use (the "Terms") are an agreement between you and Drobe ("Drobe", "we", "us" or "our"). They govern your use of the Drobe: Wardrobe & Stylist iOS app (the "App"), the website at drobe-app.com, and related services (together, the "Services"). Our Privacy Policy explains how we handle your information and forms part of these Terms.

1. Acceptance

By downloading, accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of someone else, you confirm you are authorized to accept these Terms for them.

2. Eligibility

You must be at least 13 years old to use the Services, or at least 16 if you live in the European Economic Area or the United Kingdom. If you are under the age of majority where you live, you may only use the Services with the permission of a parent or guardian, who agrees to these Terms for you. You may not use the Services if the law prohibits you from doing so.

3. Your account

• You need an account to use most features. You can sign up with an email address and password, with Sign in with Apple, or with Sign in with Google. Sign-in is provided by our authentication provider, Clerk.
• Give accurate information and keep it up to date. Keep your sign-in details secure. You are responsible for everything that happens under your account. Tell us right away at support@drobe-app.com if you suspect unauthorized use.
• Your username must not impersonate others, infringe anyone's rights or be offensive. We may reclaim or change usernames that break these Terms.
• You can delete your account at any time in the App under Profile → Delete account. This permanently deletes your data as described in the Privacy Policy.

4. Drobe Pro subscriptions & billing

Some features, such as AI wardrobe scans and virtual try-ons, require a paid Drobe Pro subscription. Drobe Pro is sold through Apple's In-App Purchase system. RevenueCat, our service provider, checks purchases and manages subscription status.

Prices may vary by country or region and may include applicable taxes. The App shows the price in your local currency before you confirm.

• Cancellation. If you cancel, you keep access to Drobe Pro until the end of the period you have paid for, and you will not be charged again. Deleting the App or your Drobe account does not cancel your subscription. Cancel it through Apple.
• Refunds. Apple handles all payments and refunds under its policies. To request a refund, visit reportaproblem.apple.com. We cannot issue refunds for purchases made through Apple.
• Price changes. If we change the price of a subscription, Apple will tell you in advance and, where required, ask for your consent before the new price applies.
• Restoring purchases. Your subscription is linked to your Drobe account. If you reinstall the App or switch devices, use "Restore" in the App to restore an active subscription bought with the same Apple ID.
• Fair use. AI features use costly computing resources. To protect the Services for everyone, we may apply reasonable limits to unusually heavy or automated use.

5. Your content

"Your Content" means the photos you upload or approve, your profile, your messages to Luna, the outfits and ideas you save, links you share into the App, and everything created from them for you. This includes cut-outs, product pictures, descriptions and try-on images.

• You own it. As between you and us, you keep all rights you have in Your Content.
• License to process it. You give Drobe a worldwide, non-exclusive, royalty-free license to host, store, copy, process, analyse, modify (for example, cutting out and re-drawing clothing items) and display Your Content. This license is only for operating and providing the Services to you. It includes sending Your Content to our service providers, such as OpenAI for AI processing, as described in our Privacy Policy. It ends when you delete Your Content or your account, except for copies kept for a limited period as that policy describes. We do not use Your Content for advertising or to train AI models.
• Your responsibility. Only upload content that you have the right to use. Don't upload photos of other people without their permission. Never upload photos of anyone else for try-on.
• Sharing. If you share your wardrobe with friends, where that feature is available, they can see the pieces you have chosen to share as described in the Privacy Policy.

6. AI features & output

Drobe uses artificial intelligence to detect clothing, draw item pictures, write descriptions, suggest outfits and shopping ideas through Luna, and create virtual try-on images ("AI Output").

• AI Output may be wrong. It may miss items, mislabel colours, materials, brands or sizes, or create items that look different from the real ones. Try-on images are illustrations. They do not accurately show fit, size, colour, body shape or how a garment will look on you.
• Not professional advice. Styling suggestions are for inspiration and entertainment only. They are not professional, medical, financial or other expert advice. Use your own judgment before you buy or wear anything.
• Shopping suggestions are not endorsements. Luna's shopping ideas and the "Find similar" results are generated searches. They are not recommendations of any seller, product, price or availability.
• Subject to these Terms, you may use the AI Output created for you for personal, non-commercial purposes. Similar output may be produced for other users.

7. Acceptable use

You agree not to:

• upload content that is illegal, sexually explicit or exploitative, harassing, hateful, violent or otherwise harmful, or any content involving minors in an inappropriate way,
• upload photos of another person, or use try-on to depict another person, without their consent,
• use the Services to create deceptive, defamatory or non-consensual images of anyone,
• infringe anyone's intellectual property, privacy or other rights,
• reverse engineer, decompile or try to extract the source code or models of the Services, except where the law allows it,
• access the Services through bots, scrapers or other automated means, or interfere with, overload or try to bypass the security or usage limits of the Services,
• resell, sublicense or commercially exploit the Services without our written permission,
• use the Services in violation of any law or the usage policies of our AI providers.

We may remove content or limit access where we reasonably believe these rules have been broken.

8. Third-party services, links & shopping

The Services work with third-party services, including Apple, Google (Sign in with Google and Google Lens), Pinterest, and online stores and search engines such as Google Shopping, Zara, H&M, SHEIN and Temu. We do not control these services and are not responsible for their content, products, prices, availability, policies or practices. Your use of them is governed by their own terms and privacy policies. Any purchase you make from a third-party store is solely between you and that store. Drobe is not affiliated with these brands, and their names are used only to describe where a search will take you.

9. Our intellectual property

We or our licensors own the Services, including the App, its design, software, models, the look library, and the Drobe and Drobi names, logos and characters. All of these are protected by intellectual property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved. If you send us feedback or suggestions, we may use them without any obligation to you.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you seriously or repeatedly breach these Terms, if the law requires it, or if continuing would expose us or others to harm or liability. Where reasonable, we will tell you beforehand. We may also discontinue the Services or any part of them. If we discontinue the Services entirely, we will try to give reasonable notice. Sections that by their nature should survive termination will survive, including sections 5 (license limits), 6, 9, 11, 12, 13 and 14.

11. Disclaimers

To the fullest extent permitted by law, the Services and all AI Output are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory. These include warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Services will be uninterrupted, error-free or secure, or that Your Content will never be lost. Keep your own copies of photos that matter to you.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. Nothing in these Terms limits your rights as a consumer that cannot be limited by law.

12. Limitation of liability

To the fullest extent permitted by law, Drobe and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages. They will also not be liable for any loss of profits, data, goodwill or use, arising out of or related to the Services, even if advised of the possibility of such damages. Our total liability for all claims relating to the Services is limited to the greater of (a) the amounts you paid for Drobe Pro in the 12 months before the event giving rise to the claim, and (b) US $50.

These limits do not apply to liability that cannot be limited or excluded by law. That includes liability for death or personal injury caused by negligence, for fraud, or, for users in the EEA and UK, for gross negligence or intentional misconduct.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless Drobe against claims, damages and costs, including reasonable legal fees, that arise from Your Content or from your breach of these Terms or of the law.

14. Governing law & disputes

These Terms are governed by the laws of the jurisdiction where Drobe is established, without regard to its conflict-of-law rules. Before filing a claim, please contact us at support@drobe-app.com so we can try to resolve the dispute informally. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring proceedings in your local courts. EU consumers may also use the EU's online dispute resolution resources.

15. Apple terms

These Terms are between you and Drobe only, not Apple Inc. ("Apple"). Apple's Licensed Application End User License Agreement (the "Standard EULA", available at apple.com/legal/internet-services/itunes/dev/stdeula) also applies to your use of the App. Where these Terms and the Standard EULA conflict, the terms more protective of you apply to the extent permitted. In addition:

• Drobe, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App. These include product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the App infringes a third party's intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and tell you in the App or by email before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms. If you do not agree, stop using the Services and delete your account.

17. General

These Terms, together with the Privacy Policy and the Standard EULA, are the entire agreement between you and Drobe about the Services. If any provision is found unenforceable, the rest remain in effect. If we do not enforce a right, we have not waived it. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of assets.
